1. Purpose

These Terms of Use (hereinafter "Terms") define the terms and conditions of use of the MoodDish® mobile application (hereinafter "the Application") published by CodeBySergen.

Using the Application implies full and unconditional acceptance of these Terms. If you do not accept these Terms, please do not use the Application.

2. Description of the Service

MoodDish® is a mobile application available on iOS and Android that offers personalized recipes based on the user's mood. The Application uses algorithms and artificial intelligence models to suggest dishes adapted to the emotional state declared by the user.

Main features include:

  • Mood selection
  • Personalized recipe suggestions
  • Saving favorite recipes
  • Recipe history
  • Recipe sharing
  • Community area (posts, comments, reporting)
  • AI-powered cooking assistant and recipe generation (premium features)

3. Access to the Service

The Application is freely accessible from Apple's App Store and Google Play. Premium features are available through auto-renewable subscriptions.

The user is responsible for their equipment (smartphone, internet connection) required to use the Application.

MoodDish® reserves the right to temporarily suspend or interrupt access to the Application for maintenance, update, or security reasons. Whenever possible, users will be notified in advance of any planned interruption. No compensation is due for short interruptions related to maintenance or service security.

3b. Subscriptions and Payments

Available Plans

MoodDish® offers the following auto-renewable subscriptions, identical on iOS and Android:

  • MoodDish+ Monthly : €6.99 / month
  • MoodDish+ Yearly : €49.99 / year (approx. €4.17 / month)
  • MoodDish+ Monthly, Launch Offer : €4.99 / month, price locked for as long as the subscription stays active. Limited to the first 1,000 subscribers; the launch price cannot be reinstated once cancelled.

Automatic Renewal

Subscriptions automatically renew at the end of each period (monthly or yearly) unless cancelled at least 24 hours before the renewal date. The amount is charged to the user's Apple ID account (on iOS) or Google account (on Android) at purchase confirmation, then at each renewal.

Cancellation

On iOS: Settings > [account name] > Subscriptions.

On Android: open the Google Play Store > Profile > Payments & subscriptions > Subscriptions.

Cancellation takes effect at the end of the current period. No prorated refund is granted for the remaining period.

Refund Policy

Refund requests are handled by Apple or Google depending on the purchase platform, in accordance with their respective terms:

Pursuant to Article L.221-28 of the French Consumer Code, by confirming the purchase the consumer expressly requests immediate access to the digital content and waives the 14-day right of withdrawal. This waiver is required by Apple and Google before the first charge.

Privacy Policy and Terms

By subscribing, the user agrees to these Terms of Use and our Privacy Policy.

4. Registration and User Account

Using certain features may require creating a user account. The user agrees to provide accurate information and keep it up to date.

The user is solely responsible for the confidentiality of their login credentials and any activity performed from their account.

In the event of suspected fraudulent use, the user must immediately notify MoodDish® at: [email protected]

5. Intellectual Property

All elements of the Application (texts, images, graphics, logo, icons, sounds, software, etc.) are protected by intellectual property laws.

Any reproduction, representation, modification, publication, or adaptation of any element of the Application, by any means or process, is prohibited without the prior written authorization of CodeBySergen.

The MoodDish® brand and associated logo are trademarks of CodeBySergen. Any unauthorized use constitutes an infringement.

6. Liability

6.1 Publisher Liability

MoodDish® strives to ensure the accuracy and currency of information provided through the Application. However, MoodDish® cannot guarantee the accuracy, precision, or completeness of the information made available.

Recipes are provided for informational purposes only. The user remains solely responsible for adapting recipes to their dietary needs, allergies, or medical restrictions.

6.2 User Liability

The user agrees to:

  • Use the Application in accordance with its intended purpose
  • Not interfere with the integrity of the Application
  • Not collect information about other users
  • Respect intellectual property rights

6b. User-Generated Content and Zero Tolerance

MoodDish® allows users to publish content in the community area (photos, recipes, comments). By publishing content, the user declares to be its author or to hold the necessary rights, and grants MoodDish® a non-exclusive, worldwide, royalty-free licence to display this content within the Application.

MoodDish® enforces a zero-tolerance policy against any offensive content or behaviour. The following are strictly prohibited:

  • Harassment, intimidation, threats against other users
  • Hate speech, discriminatory content, incitement to violence
  • Sexual, pornographic, or explicit content
  • Spam, unsolicited advertising, deceptive content
  • Identity impersonation
  • Any illegal or otherwise objectionable content

Offenders may face immediate content removal, temporary suspension, or permanent ban of their account, without prior notice or refund of any active subscription.

Moderation combines automated detection (AI), user reports, and manual review. Any user may report content or block another user directly from the Application.

6c. Liability Limits: Well-being and Health

MoodDish® offers recipe suggestions based on emotional and sensory preferences declared by the user. The Application is not a medical tool and does not provide nutritional, medical, psychological, or psychiatric advice.

Recipes and accompanying explanations cannot replace the opinion of a qualified healthcare professional. In case of mood disorders, eating disorders, specific nutritional questions, or any medical condition, please consult a physician, a qualified dietitian, or a psychologist.

In case of psychological distress, support resources are available in France:

  • 3114: national suicide prevention helpline, 24/7, free and anonymous
  • SOS Amitié: +33 9 72 39 40 50, anonymous listening line
  • 15 (SAMU) or 112: life-threatening emergency

Users outside France should refer to their local emergency services or mental health support lines.

7. Personal Data

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

By using the Application, the user consents to the processing of their personal data in accordance with this policy.

8. Amendment of Terms

MoodDish® reserves the right to modify these Terms at any time. Users will be notified of any substantial changes via an in-app notification.

Continued use of the Application after modifications constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, French courts shall have exclusive jurisdiction.
